battery and lockup

I have a strange problem rooted incredible 1 running cm7 battery hits 26% phone locks up does it every time. Do a battery pull boot the phone back up and battery says 20% happens everytime. Anyone ever see this problem? Its a new one to me not sure if I have a battery issue or something weird in the rom. I did clear the battery stats after flashing cm7.
